Terms & Conditions for Sturgeon Station Travel Center Gift Cards

1. The following Terms and Conditions (“Terms”) apply to the purchase, acceptance, and use of the Sturgeon Station Travel Center (“SSTC”) Gift Cards. These Terms constitute a legally binding agreement (the “Agreement”) between SSTC and you as the cardholder (“you” or “your”).  By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms. For purposes of these Terms, the term “SSTC” shall be interpreted broadly, encompassing any of their successors, assigns, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents.
2. Your Gift Card balance does not expire.  However, a Gift Card may be subject to escheat to an appropriate government if required by applicable unclaimed property laws. Your Gift Card may not be usable to purchase goods or services in the event that SSTC ceases business or the program is terminated for business reasons. 
3. Gift Cards are not returnable or refundable.
4. You may use Gift Cards only at SSTC, and not at the adjacent Sonic restaurant.  
5. Gift Cards are redeemable towards purchases of eligible goods and services. Eligible goods and services are subject to change without notice in SSTC’s sole discretion.
6. By purchasing or holding a Gift Card, you are certifying and representing to SSTC that you will comply with all applicable laws, these Terms, and that you will not use the Gift Card in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers or SSTC.
7. You agree not to purchase, use, transfer or tamper with a Gift Card in any manner that is harmful to SSTC, its affiliates, or its customers. SSTC reserves the right without notice to refuse to accept a Gift Card and to take further action including but not limited to balance forfeiture and suspension or termination of accounts.
8. SSTC does not replace lost or stolen Gift Cards, and shall not have liability to you for lost or stolen Gift Cards. 
9. You agree that the laws of the Kootenai Tribe of Idaho, without regard to principles of conflict of laws, will govern these terms and conditions and any dispute that may arise between you and SSTC related to your purchase or use of a Gift Card.
10. SSTC reserves the right to change these terms and conditions without notice, from time to time at our sole discretion. All terms and conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.
11. SSTC makes no representations or warranties of any kind, express or implied, with respect to any Gift Card including, but not limited to, any express or implied warranty of merchantability or fitness for a particular purpose. To the full extent permitted by law, if a Gift Card is non-functional, your sole remedy shall be replacement of that Gift Card. 
12. Notwithstanding any other terms or provisions of these Terms, you understand and agree that SSTC, by entering into this Agreement, does not waive its sovereign immunity from suit, nor does it waive, alter, or otherwise diminish its sovereign rights, privileges, remedies, or defenses.
